Terms of Use

These terms apply to Turtle Toss (the “app”), published by Yolk Labs, Inc. (“Yolk Labs”, “we”). By downloading or playing the app you agree to them. If you do not agree, please do not use the app.

Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, as permitted by the App Store Terms of Service. This is a licence to use the app, not a sale of it.

What you may not do

• Copy, sell, rent, sublicense or redistribute the app.
• Reverse engineer, decompile or attempt to derive the source code, except where that right cannot lawfully be restricted.
• Modify the app or interfere with its normal operation, including tampering with scores submitted to leaderboards.
• Use the app in any way that breaks the law or infringes someone else’s rights.

Fair play

Leaderboards and multiplayer races are meant to be fair. We may ask Apple to remove scores obtained by modifying the app or the device, and we may report accounts to Apple for behaviour that ruins the game for other players.

Our content

The app, its characters — including Shelly — artwork, music, sound and code are owned by Yolk Labs and protected by copyright and other laws. These terms give you no rights to our trade marks or branding.

Game Center and Apple

Leaderboards, achievements and multiplayer use Apple’s Game Center, and your use of it is subject to Apple’s terms. Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these terms and may enforce them against you.

Availability and changes

We may update, change or discontinue the app or any of its features at any time. Game progress is stored on your device; we do not back it up and cannot restore it if it is lost, for example when an app or device is deleted or reset.

No warranty

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error free.

Limitation of liability

To the fullest extent permitted by law, Yolk Labs will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising out of your use of the app. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules, except where the mandatory consumer laws of your country of residence apply.

Changes to these terms

If we change these terms we will post the updated version here and change the date above. Continuing to use the app after that means you accept the change.
